1. Acceptance of Terms

These Terms of Use ("Terms") form a binding agreement between you and Trelven LLC ("Trelven," "we," "us," or "our") governing your access to and use of our website at trelven.com and the applications we publish (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 13 years old to use the Services, and at least the age of majority in your jurisdiction to enter into these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

3. License

Subject to your compliance with these Terms, Trelven grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. We may modify, suspend, or discontinue any part of the Services at any time without notice.

4. User Accounts

Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@trelven.com if you suspect unauthorized access.

5. User Conduct

You agree not to:

• Use the Services in violation of any law or these Terms.
• Infringe the intellectual property, privacy, or other rights of others.
• Upload or transmit malware, viruses, or other harmful code.
• Attempt to gain unauthorized access to the Services, related systems, or other accounts.
• Reverse engineer, decompile, or attempt to extract the source code of the Services, except where applicable law permits.
• Use the Services to harass, defraud, or harm others.
• Scrape, harvest, or otherwise collect data from the Services using automated means without our permission.

6. User Content

Where the Services let you submit content, you retain ownership of that content. You grant Trelven a worldwide, royalty-free license to host, store, reproduce, and display that content solely as needed to operate and improve the Services. You are responsible for what you submit and represent that you have the rights to do so.

7. Intellectual Property

The Services, including all software, design, text, graphics, and the Trelven name and marks, are owned by Trelven or its licensors and protected by intellectual property laws. Except for the license granted in Section 3, no rights are granted to you in the Services.

8. Third-Party Services

The Services may link to or integrate with third-party services. We are not responsible for those services, and your use of them is governed by their own terms and privacy policies.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR THAT ANY ERRORS WILL BE CORRECTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRELVEN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS.

11. Indemnification

You agree to defend, indemnify, and hold harmless Trelven from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Services at any time, including for violations of these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and dispute resolution) will survive.

13. Governing Law

These Terms are governed by the laws of the United States and the state in which Trelven is organized, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts of that jurisdiction, and you consent to personal jurisdiction there.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the Services after an update constitutes acceptance of the revised Terms.
